2. Applicability

These Terms and Conditions apply to all offers made by Chador and to all distance contracts concluded between Chador and consumers through our webshop, unless otherwise agreed in writing.

Nothing in these Terms and Conditions limits or excludes any mandatory consumer rights under applicable Dutch or European Union law.

3. Offers and Prices

All prices displayed on our webshop are in euros (€) and include VAT, where applicable. Shipping costs and any additional charges are displayed separately before the customer completes the order.

We aim to ensure that all product descriptions, prices and other information on our website are accurate and up to date. Obvious errors or mistakes, including typographical or pricing errors, do not bind Chador where permitted by law.

Offers are subject to availability. We reserve the right to change prices and offers for future purchases. Changes will not affect orders that have already been accepted, except where permitted by law.

4. Formation of the Agreement

A purchase agreement is concluded when the customer places an order and receives an order confirmation from Chador, subject to applicable law. Chador reserves the right to refuse or cancel an order where there is a legitimate reason, such as suspected fraud, an obvious pricing error or product unavailability. If we are unable to fulfil an order, we will inform the customer as soon as reasonably possible and refund any amount already paid for products that cannot be supplied.

Any refusal or cancellation will be handled in accordance with applicable consumer law.

5. Payment

Payment must be made in full using one of the payment methods offered at checkout.

Available payment methods may include iDEAL, PayPal, Bancontact and other payment options displayed on our website. The available methods may change from time to time.

After placing an order, the customer will receive an order confirmation by email stating the order details and total amount payable.

Orders will be processed once the required payment has been successfully completed, unless otherwise stated.

6. Shipping and Delivery

Chador aims to dispatch orders within 1–3 working days for deliveries within the Netherlands and Belgium. Deliveries to other European countries generally take approximately 3–6 working days, depending on the destination and carrier.

These timeframes are estimates and refer to our usual processing and delivery arrangements. The estimated delivery information shown at checkout or communicated for a particular order will also apply.

During holidays, promotional periods and new collection launches, processing and delivery may take longer. If a delay occurs, we will inform the customer as soon as reasonably possible.

If we fail to deliver within the agreed delivery period, the customer may, where required by law, give us an appropriate additional period to deliver. If delivery still does not take place within that additional period, the customer may terminate the agreement and receive a refund. An additional period is not required in circumstances where the law allows the customer to terminate the agreement immediately.

Nothing in these Terms and Conditions excludes or limits the customer’s statutory rights in the event of late or non-delivery.

We use PostNL and other delivery providers where applicable. A tracking code will be sent by email when available after dispatch.

7. Delivery Risk

The risk of loss of or damage to products remains with Chador until the customer, or a third party designated by the customer other than the carrier, has physically received the products.

If the customer independently arranges a carrier that was not offered by Chador, the risk may transfer when the products are handed over to that carrier, where permitted by law.

If a parcel is lost or damaged during delivery, the customer should contact info@chador.nl so that we can investigate the matter and assist with an appropriate solution.

8. In-Store Pickup

Customers may select free in-store pickup at our Gouda location if this option is available at checkout.

Once the order is ready for collection, the customer will receive an email notification. We generally aim to have pickup orders ready within two working days.

Customers should wait for the collection confirmation before visiting the store. Any specific collection instructions will be included in the confirmation email.

9. Product Availability and Stock

We make reasonable efforts to ensure that product availability displayed on our webshop is accurate. However, an item may occasionally become unavailable due to stock discrepancies or unexpected circumstances.

If we cannot supply an ordered item, we will notify the customer and refund the amount paid for that item. If the unavailable item affects the entire order, we will arrange an appropriate refund for the undelivered order.

This provision does not limit any other rights the customer may have under applicable law.

10. Pre-Orders

From time to time, Chador offers products for pre-order. Pre-order products are identified as such on the product page, together with an estimated delivery date or period where available.

Pre-order products can be purchased through the usual checkout process. After placing an order, the customer will receive an order confirmation.

A pre-order may be placed separately or together with products that are already in stock. If the customer combines pre-order products and in-stock products in one order, the entire order may be held until all products are available. This arrangement will be communicated before the customer completes the purchase.

Estimated pre-order delivery dates are indicative unless a specific binding delivery date has been agreed.

If a pre-order is significantly delayed or cannot be supplied, we will inform the customer. The customer retains all applicable statutory rights, including the right to terminate the agreement and receive a refund where the legal requirements are met.

11. Right of Withdrawal Returns

Consumers who purchase products online generally have the right to withdraw from the purchase without giving a reason within 14 days of receiving the product.

For orders consisting of multiple products delivered separately, the withdrawal period generally starts on the day the customer receives the last product.

To exercise this right, the customer must inform Chador of the decision to withdraw within the applicable 14-day period. The customer then has a further 14 days from the date of notifying us to send the products back.

The customer may notify us by email at info@chador.nl or by using the model withdrawal form included at the end of these Terms and Conditions. Use of the model form is not mandatory.

During the withdrawal period, the customer may inspect and handle the products only to the extent reasonably necessary to establish their nature, characteristics and functioning, as they would in a physical store.

If a product is handled beyond what is necessary for such inspection, the customer may be liable for any resulting reduction in value, as permitted by law.

The right of withdrawal does not affect the customer’s statutory rights concerning faulty, damaged or incorrectly supplied products.

12. Return Procedure and Return Costs

To return products following withdrawal, the customer should notify Chador within the applicable withdrawal period and send the products back within the following 14 days.

Returns should be sent to:

Chador — Returns
Gildenburg 76
2804 VK Gouda
The Netherlands

The customer is responsible for the direct cost of returning products when exercising the right of withdrawal, provided this responsibility has been clearly communicated before the purchase.

If a product is faulty, damaged on arrival or incorrectly supplied, the customer should contact info@chador.nl before returning it. Chador will arrange an appropriate solution in accordance with applicable law, including covering reasonable return costs where required.

Customers are advised to retain their proof of postage and tracking information until the return has been processed.

13. Refunds

If a customer validly exercises the right of withdrawal, Chador will reimburse the payments received for the returned products, including the cost of standard outbound delivery where required by law.

If the customer selected a more expensive delivery method than the least expensive standard delivery option offered by Chador, we are not required to reimburse the additional cost of that upgraded delivery method.

If the customer withdraws from only part of an order, the original delivery costs do not generally need to be reimbursed where the law provides an exception.

Refunds will be issued without undue delay and no later than 14 days after Chador is informed of the customer’s decision to withdraw. We may withhold the refund until we have received the returned products or the customer has provided evidence that the products have been sent back, whichever occurs first.

Refunds will normally be made using the same payment method as the original transaction, unless the customer expressly agrees to another method. No refund fees will be charged.

These provisions do not limit any additional refund rights arising from faulty products, non-delivery or other circumstances under applicable law.

14. Exceptions to the Right of Withdrawal

The right of withdrawal may be excluded only in the circumstances permitted by applicable law.

For example, it may not apply to:

  • Products made to the consumer’s specifications or clearly personalised.
  • Sealed products that are not suitable for return for health protection or hygiene reasons, where the seal has been broken after delivery and the legal conditions for this exception are met.

Any applicable exception will be communicated to the customer before purchase.

A product is not automatically excluded from the right of withdrawal simply because it has been opened or tried on. The relevant statutory conditions must be met.

15. Legal Guarantee and Conformity

Chador is responsible for ensuring that products conform to the purchase agreement and meet the reasonable expectations a consumer may have of them, taking into account the product description, its characteristics and the circumstances of the purchase.

If a product is faulty, damaged, incorrectly supplied or otherwise does not conform to the agreement, the customer should contact info@chador.nl and explain the issue.

Depending on the circumstances and applicable law, the customer may be entitled to a repair, replacement, price reduction or termination of the agreement with a refund.

Any remedy will be provided in accordance with the applicable statutory requirements. The customer’s legal guarantee rights are not limited to any voluntary warranty offered by Chador or by a manufacturer.

16. Complaints

If a customer is dissatisfied with a product or our service, they can contact us at info@chador.nl.

Please include the order number and a clear description of the issue. Photographs may be included where relevant to help us assess a product complaint.

We aim to acknowledge and address complaints promptly and to provide a substantive response within 14 days. If a complaint requires more time to investigate, we will inform the customer and indicate when a more detailed response can be expected.

Customers retain their statutory rights regardless of whether a complaint is submitted within our preferred response period.

17. Liability

Nothing in these Terms and Conditions excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

Chador is responsible for fulfilling its legal obligations under the purchase agreement and applicable consumer protection legislation.

To the extent permitted by law, Chador is not liable for indirect or consequential losses that are not reasonably foreseeable or that are not legally attributable to Chador.

Nothing in this section limits liability for fraud, intentional misconduct, gross negligence where liability cannot legally be excluded, or any other liability that cannot be limited under applicable law.

18. Force Majeure

Chador may be temporarily prevented from fulfilling an obligation by circumstances beyond its reasonable control, such as natural disasters, serious disruptions to transport networks, war, government measures or major interruptions to essential services.

If such circumstances affect an order, we will inform the customer where reasonably possible and explain the expected impact.

This provision does not remove any mandatory consumer rights. If an order cannot be fulfilled, the customer’s rights to terminate the agreement and receive a refund, where applicable, remain unaffected.

19. Applicable Law and Disputes

These Terms and Conditions are governed by Dutch law, without prejudice to any mandatory consumer protection rules that apply in the country where the consumer resides.

Any dispute will be submitted to the competent court under the applicable legal rules. Consumers retain any mandatory rights they may have to bring proceedings before the courts of their country of residence.

20. Amendments to These Terms and Conditions

Chador may update these Terms and Conditions from time to time.

The version published on our website at the time of the customer’s order applies to that purchase, subject to any mandatory legal requirements. Changes will not retroactively remove rights that consumers have already acquired.

21. Model Withdrawal Form

Consumers may use the following form to exercise their right of withdrawal. Using this form is optional; withdrawal may also be communicated by another clear statement.
